The drafting and formation of Contracts of Employment

This would include drafting a contract of employment and providing advice to employers who wish to ensure their contracts of employment are tailored for both the employer’s type of work and that it accurately relates to the type of employee i.e. full-time, part-time, fixed-term worker etc. We also ensure the Employer complies with the Terms of Employment (Information) Acts 1994-2001. We can also assist in the drafting and formation of workplace policies and the creation of employee manuals which can outline an employer’s policy in respect of rules relating to company property, conduct at work related social events, conflicts of interest, computer use policy and sickness/absenteeism policy.

Interview and Recruitment Process

We provide legal advice to employers who wish to fully understand and clarify any pre-employment contract issues some of which might include:

  • How to avoid an allegation of discrimination at an interview?
  • What are the proper procedures for offering terms of employment subject to a satisfactory medical examination?
  • How not to breach Data protection law when requesting background checks e.g. Garda criminal checks, when hiring someone?

Redundancy/Termination of Employment

We also advise clients on industrial relations, including collective redundancies and redundancy packages as well as the proper procedures which should be in place when dismissals are being implemented.
