The principal role of the MIBI is to compensate victims of road traffic accidents caused by uninsured and unidentified vehicles. The Agreement of 2009 sets out the rights given to persons who sustain damage and/or injuries in a road traffic accident caused by an uninsured vehicle or unidentified vehicle.

In order to claim from the MIBI you have to satisfy the following criteria:

  • You were involved in a road traffic accident caused by a mechanically propelled vehicle
  • Your are claiming for vehicle/property damage, personal injury or both
  • You comply with the terms of the MIBI agreement in relation to the investigation of the driver of the vehicle, including co-operating with Gardaí, making the appropriate demands under the Road Traffic Acts to prove if there is insurance, sending the necessary letters and properly completing the MIBI claim application form.

Once the above has been attended to, the MIBI will nominate an insurance company to act on their behalf. The insurance company will in turn nominate defence solicitors to represent them.
